I was stopped a stop sign on May 31, 2013 in my 2007 Prius. The driver of a pick up truck behind me slammed into my car at full speed.

My car was substantially damaged with the bumper, rails, lift gate, rear fender and rear window destroyed. I called my insurance company and they suggested calling the driver's company, Safeco. Safeco sent out an adjuster to estimate the damage.

Safeco decided to use almost all used parts including used structural parts, specifically not approved by Toyota. I have had to hire a lawyer to fight it because of their bad faith.

Monetary Loss: $30000.

After 13 months and a lot of drama, I think I have finally resolved all with Safeco. I had to remove Safeco from the equation and insist my insurance company settle with me and go after Safeco for reimbursement.

I settled with my company in about 10 days. Safeco and my insurance company were in arbitration for 6-8 months over the claim.

The offer for medical covered my out of pocket costs only and I would have agreed but they wanted a full and unconditional release of liability. I was not willing to sign that without any compensation.

I ended up in Los Angeles Small Claims Court and got a judgment for the full medical amount and did not need to sign any releases.

I still have neck stiffness and a couple of bone chips floating in my neck but hopefully all will remain stable.

My claim was against Safeco's client NOT Safeco. Their insured was forced into a lot of inconvenience and now runs the risks of a later claim that I hope never happens.

Safeco was not willing to leave well enough alone. Rather than their insured paying me, Safeco issued a check minus the court-approved court costs. I cashed the check and sent a note to Safeco and their insured that the check was short.

I received a second check for the FULL amount resulting in an overpayment. I called Safeco's 800 number to ask about the overpayment and found out that both the original check and the second check had been stopped by Safeco. I also got a notice from my bank that the first check I deposited had been stopped and fees assessed on my account for the stopped check. Either Safeco's great incompetence or the adjuster wanted to mess with me yet again after all the grief.

Today I received a third check for the full amount but no assurance from the adjuster that she won't put a stop on it one more time.

After battling it out with me for over a year, the Los Angeles based Safeco adjuster apparently felt the need to mess with no. I did not receive either a call or email stating that they stopped payment. They baited me to see if I would cash both checks but instead she got found out once again. Because of Safeco attempting to charge administrative and storage charges against a payment to me, I reported their illegal practice to the state insurance commission.

My subsequent dealings with Safeco all smacked of retaliatory behavior. Words of advise: if hit by a Safeco insured driver in Los Angeles, make sure you wait for the police. DO NOT let Safeco handle the claim even if they request it. Make sure you go through your own insurance company and let them deal with Safeco.

Safeco will not give you a fair or reasonable deal and they will withhold funds in an attempt to make you settle. They are bullies and engage in bully tactics.

So sorry for your troubles. I was rearended by a safeco insured in April of 2011.

No further information no settlement no word.

I hope your situation gets resolved . Every one else on here too.

I am having trouble with the same thing except the body shop rigged everything back together. I have Mutual Benefit for insurance and they won't do a thing about it.

No one wants to help what so ever. I live in Lancaster, Pa. If there is anyone out there that can help, could you send me info at Drailed2288@***.com.

Six months is long enough to be told they wont help. Thank You!
